By accessing or using Tracker Fx, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Tracker Fx is a trading journal and analytics platform designed to help traders track, review, and improve their performance. The Service includes performance analytics, trade journaling, account management tools, and reporting features, as further described on the Tracker Fx website.

The Service is provided on a subscription basis as described in Section 5.

This requirement exists because the Service is intended for use alongside live or demo trading accounts, which require users to be of legal age in their respective jurisdictions.

The Service is available worldwide. It is your responsibility to ensure that using Tracker Fx is lawful in your country of residence.

To access the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at support@trackerfx.com if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

Tracker Fx offers the following paid plans:

All prices are in US Dollars (USD). Subscriptions renew automatically at the end of each billing cycle unless cancelled beforehand. You authorise us to charge your payment method on file for each renewal.

We reserve the right to change pricing with at least 30 days' notice communicated via email or through the Service.

New users may access the Service free of charge for 7 days. The Free Trial provides access to all features of the selected plan.

We will send a reminder email 3 days prior to the end of your Free Trial period.

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period.

If you believe a charge was made in error, contact us at support@trackerfx.com within 7 days and we will review your case.

Consumers in the European Union may have statutory rights to a cooling-off period or refund under applicable consumer protection legislation. Nothing in these Terms limits any rights you may have under mandatory applicable law.

Tracker Fx stores your trading data - including trade history, journal entries, notes, tags - on our secure servers. This data is used solely to provide and improve the Service.

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) as implemented in Portugal. Please refer to our Privacy Policy for full details.

You retain ownership of your data. You may request deletion of your account and associated data at any time by contacting support@trackerfx.com.

Tracker Fx connects to supported trading platforms using official, read-only APIs. You may revoke any connection at any time through the respective platform's account settings or from within Tracker Fx.

Tracker Fx is not affiliated with, endorsed by, or in partnership with any third-party trading platform provider.

Tracker Fx operates an optional affiliate programme that allows approved participants ("Affiliates") to earn commissions by referring new paying subscribers to the platform.

Eligibility & Application

To join the affiliate programme, you must apply through the Tracker Fx Affiliate Portal and receive written approval from us. We reserve the right to accept or reject applications at our sole discretion and to suspend or terminate any affiliate relationship at any time.

Commission Structure

Approved Affiliates earn a commission on qualifying referrals as defined in the Affiliate Dashboard at the time of approval. Commission rates, payment thresholds, and payout schedules are detailed in the Affiliate Dashboard and may be updated with 30 days' notice.

Tracking & Attribution

Referrals are tracked via unique affiliate links. A referral qualifies when the referred user completes a paid subscription through the Affiliate's unique link within the applicable attribution window. We use cookies and session identifiers for tracking; users are informed of this in our Privacy Policy.

Affiliate Obligations

As an Affiliate, you agree to:

• Promote Tracker Fx honestly, accurately, and in compliance with all applicable laws
• Clearly and conspicuously disclose your affiliate relationship in all promotional content, as required by applicable advertising standards (including FTC guidelines where applicable)
• Not make false or misleading claims about the platform, its features, or results
• Not engage in spam, unsolicited messaging, or prohibited marketing practices
• Not use our trademarks or brand assets without prior written approval
• Not self-refer or generate fraudulent referrals
• Not engage in cookie stuffing, click fraud, or artificial traffic generation
• Not promote the platform on sites containing illegal, offensive, or inappropriate content

Payment

Commissions are paid monthly, subject to the minimum payout threshold specified in the Affiliate Dashboard. We reserve the right to withhold commissions pending investigation if we suspect fraudulent or abusive behaviour.

Termination of Affiliate Status

We may terminate your affiliate status immediately, with or without notice, for breach of these Terms or affiliate programme rules. Unpaid commissions earned on qualifying referrals prior to termination will be paid in the next payment cycle, unless termination was due to fraud or policy violation, in which case commissions may be forfeited.

We aim to provide a reliable and continuously available service, but we do not guarantee uninterrupted access to the platform. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will endeavour to provide advance notice)
• Unplanned technical issues or outages
• Third-party infrastructure failures (e.g., cloud hosting, payment processors)
• Events outside our reasonable control

We will not be liable for any loss or damages arising from periods of unavailability. If an outage exceeds 72 consecutive hours within a single billing period, you may contact support to discuss remedies at our discretion.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to the Service, its servers, or any connected systems
• Reverse-engineer, decompile, or otherwise attempt to extract the source code
• Scrape, copy, or redistribute content from the Service without our written consent
• Use the Service on behalf of a third party without their consent
• Transmit harmful, offensive, or malicious content
• Interfere with the operation or security of the Service

Violation of these restrictions may result in immediate termination of your account without refund.

All content, design, code, branding, and technology constituting the Tracker Fx platform are the exclusive property of the company operating the Service and are protected by applicable intellectual property laws.

Your trading data and journal entries remain your own. By using the Service, you grant us a limited licence to store and process your data solely for the purpose of providing the Service.

Trading financial instruments involves significant risk of loss and may not be suitable for all investors. Past performance as reflected in your trade history is not indicative of future results.

We make no guarantees regarding the accuracy or completeness of data synchronised from third-party trading platforms.

To the maximum extent permitted by applicable law, Flow88 - Gestão de Ativos shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

Our total liability to you for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We encourage you to contact us at support@trackerfx.com before initiating any formal dispute. We will endeavour to resolve complaints within 14 business days.

If a dispute cannot be resolved informally, the parties agree to first attempt mediation through a mutually agreed mediator before resorting to litigation.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles. Any dispute that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the courts of Portugal.

If you are a consumer resident in the European Union, you may also benefit from mandatory consumer protection provisions of the laws of your country of residence, and may submit a complaint to the Online Dispute Resolution (ODR) platform operated by the European Commission at ec.europa.eu/consumers/odr.

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, cyberattacks on critical infrastructure, power failures, or failures of third-party internet or telecommunications providers.

In such events, we will notify you as soon as reasonably practicable and will resume performance as soon as circumstances permit.

Entire Agreement. These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and us regarding your use of the platform and supersede all prior agreements or understandings.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where changes are material, notify you by email.

Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
